By accepting this agreement, you may be waiving certain legal rights.

This website and all services, features, programs, and interactions made available through it (the "Site") are operated by MASTERLABS LIMITED, a company registered in Gibraltar with registration number 123237 and registered address at Suite 2, 260 Main Street, GX11 1AA, Gibraltar.

Access to and use of the Site is subject to your unconditional acceptance of these Terms. If you do not agree, you must not use the Site or any services provided by Elites Funding.

All services offered are strictly educational, evaluative, and simulation-based. Nothing on this Site constitutes investment advice, brokerage services, financial services, portfolio management, financial intermediation, or an offer to trade real financial instruments or deploy real capital on your behalf.

Elites Funding provides simulated trading environments designed to evaluate trading performance. All accounts, including evaluation accounts, funded accounts, and related programs, operate in a simulated environment using demo funds only.

No real capital is allocated to users for personal trading. Any payouts made by Elites Funding are discretionary rewards based on simulated performance and do not represent profits generated by the user in real financial markets or through the management of real client assets.

Elites Funding does not guarantee profits, payouts, trading success, account progression, or continued access to any program under any circumstances. Participation in any program does not create any partnership, fiduciary duty, employment relationship, agency, investment mandate, brokerage relationship, or vested right to capital allocation or compensation.

These Terms incorporate all other policies published on the Site, including but not limited to the FAQ, Refund Policy, Privacy Policy, AML Policy, Prohibited Trading Strategies, payout rules, challenge rules, and all trading-related requirements, restrictions, explanations, thresholds, and conditions published anywhere on the Site or communicated by the Company.

The FAQ and all rules published on the Site form an integral and legally binding part of this Agreement. Elites Funding reserves the right to modify, interpret, expand, restrict, clarify, or update such rules at any time without prior notice. It is your responsibility to remain informed of the current rules and policies applicable to your use of the Site and services.

By accessing the Site, contacting Elites Funding through email, live chat support, social media, messaging applications, community channels, or any other electronic means, you are engaging in electronic communications. You consent to receive communications from us electronically, and you acknowledge that all agreements, notices, disclosures, confirmations, statements, warnings, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

You are solely responsible for maintaining the confidentiality of your account credentials and all activity conducted under your account. You may not assign, transfer, share, lease, sell, sublicense, or otherwise make your account available to any other person or entity.

Multiple accounts, identity manipulation, use of false information, use of VPNs or VPS without disclosure where requested, device-sharing schemes, account-sharing, or any attempt to bypass system controls, verification processes, geographic restrictions, or platform safeguards may result in immediate suspension or termination of all related accounts.

Elites Funding reserves the right to suspend, terminate, restrict, flag, manually review, or otherwise limit any account at its sole and absolute discretion, without notice and without obligation to provide justification, evidence, or prior warning.

Elites Funding is committed to maintaining a high-performing and efficient platform for all users. As part of this commitment, we reserve the right to delete the account history of failed challenges after a period of 3 months. This policy helps us optimize platform performance and avoid retaining excessive or unnecessary data.

You are encouraged to save or download any records you wish to retain before the end of this 3-month period, as such data may no longer be accessible once removed.

The accounts and programs offered by Elites Funding are solely demo or simulated accounts and do not involve actual live trading by you in the financial markets. All funded accounts, evaluations, and related services operate in a simulated environment using demo funds only.

Any payouts made by Elites Funding are based on simulated trading performance and are granted solely at the company’s sole and final discretion in accordance with the applicable rules, policies, review procedures, compliance standards, and program conditions then in force.

Elites Funding does not guarantee profits, payouts, trading success, or account progression under any circumstances.

Leverage, account conditions, trading parameters, payout conditions, challenge requirements, and related settings may vary depending on the program selected and may be adjusted by Elites Funding from time to time at its sole discretion, where deemed reasonable, necessary, operationally appropriate, or commercially justified.

Elites Funding does not knowingly collect personal information from individuals under the age of 18, whether online or offline. If you are under the age of 18, you are prohibited from using the Site, services, or interacting with Elites Funding in any way.

If a minor bypasses our controls or restrictions, any actions taken by such minor are unauthorized. By accessing the Site, you agree to indemnify and hold Elites Funding harmless from any claims, actions, losses, or consequences arising from failure to comply with this age restriction.

The Site may contain links to other websites or services ("Linked Sites"). These Linked Sites are not under the control of Elites Funding, and Elites Funding is not responsible for the content of any Linked Site, including any links contained therein or any changes or updates made to such sites. The inclusion of any link does not imply endorsement by Elites Funding of the site or any association with its operators.

Certain services, functions, or features made available through the Site may be provided by third parties. By using such services or features, you acknowledge and agree that Elites Funding may share your information, including but not limited to identity data, trading behavior, device fingerprinting data, IP-related information, usage patterns, payment-related data, and verification-related information, with any third party with whom Elites Funding has a contractual relationship in order to provide the requested product, service, or functionality, or to detect fraudulent, abusive, prohibited, or non-compliant activity.

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. By using the Site, you warrant that you will not engage in any unlawful or prohibited activities in violation of these Terms or any applicable laws, regulations, sanctions programs, or requirements.

You agree not to use the Site in any manner that could damage, disable, overburden, impair, interfere with, copy, scrape, exploit, reverse engineer, or otherwise compromise its operation, integrity, content, commercial function, or the use and enjoyment of the Site by other users.

All content included on the Site is the property of Elites Funding or its suppliers and is protected by applicable intellectual property laws. You agree not to reproduce, distribute, modify, republish, reverse engineer, sell, resell, exploit, or otherwise use any content obtained from the Site except as expressly permitted.

By using the Site, you consent to monitoring, tracking, recording, profiling, and analysis of your activity, including but not limited to IP address, device fingerprinting, session behavior, payment behavior, trading behavior, usage patterns, browser data, geolocation indicators, fraud signals, and cross-account correlation indicators.

Elites Funding reserves the right to share such data with third parties, including other proprietary trading firms, fraud prevention services, compliance partners, payment providers, verification providers, legal counsel, and regulatory bodies, for the purpose of detecting abuse, fraud, prohibited activity, duplicate identities, collusion, payout manipulation, or other conduct inconsistent with our rules, policies, or commercial model.

Any trading behavior that exploits platform weaknesses, unrealistic conditions, execution asymmetries, latency, internal delays, technical faults, or simulated environment limitations is strictly prohibited.

This includes, but is not limited to:

• Arbitrage strategies exploiting latency or pricing errors
• Hedging across accounts or external platforms
• Use of delayed data or manipulated feeds
• Abusive high-frequency trading or system exploitation
• Copy trading across multiple accounts
• Any behavior inconsistent with real market conditions

Determination of prohibited conduct is made solely at the discretion of Elites Funding and is final.

Violation of these Terms may result in immediate account termination, suspension of all related accounts, cancellation or forfeiture of all profits, permanent banning from our services, refusal of future service, and no refund or payout.

Users agree not to engage in any conduct that may unlawfully, maliciously, abusively, or deceptively damage the reputation, integrity, operations, commercial interests, staff, partners, or public standing of Elites Funding.

This includes, but is not limited to:

• Publishing, distributing, or promoting false, misleading, distorted, or defamatory statements about Elites Funding, its services, employees, owners, partners, systems, payouts, rules, or operations
• Spreading misinformation regarding platform functionality, review procedures, challenge rules, payout eligibility, internal processes, or commercial practices
• Coordinated negative campaigns, review manipulation, incentivized attacks, fabricated complaints, or organized efforts intended to pressure, damage, harass, or commercially undermine the company
• Public accusations or claims that are knowingly inaccurate, materially misleading, selectively edited to misrepresent facts, or made in bad faith with intent to damage the company’s reputation
• Harassment, intimidation, threats, abusive language, blackmail attempts, extortionate conduct, or reputational threats directed at staff, community members, moderators, partners, or the company across any platform, including but not limited to Trustpilot, Discord, Telegram, social media, review platforms, forums, YouTube, or messaging applications
• Attempts to pressure the company into granting payouts, refunds, exceptions, reinstatements, or preferential treatment through reputational threats, public attacks, false claims, payment disputes, or coordinated complaints

Elites Funding fully respects the right of users to share honest experiences, opinions, and lawful criticism. However, any conduct, content, publication, review, or communication determined by Elites Funding to be intentionally false, abusive, misleading, manipulative, defamatory, extortionate, or damaging in bad faith shall constitute a violation of these Terms.

In such cases, Elites Funding reserves the right, at its sole and absolute discretion, to suspend or permanently terminate all related accounts, void any simulated profits, deny any pending or future payouts, restrict access to services, refuse future business, flag linked identities, and take any further internal, contractual, payment-related, compliance-related, or legal action deemed appropriate.

Where applicable, Elites Funding also reserves the right to challenge false public allegations, submit evidence to payment providers or review platforms, and pursue legal remedies in relation to defamation, reputational damage, bad-faith complaints, fraudulent chargebacks, or coordinated abuse of the platform.

All payouts are discretionary and subject to manual review, internal risk assessment, behavioral review, fraud screening, and compliance verification.

Meeting program rules does not guarantee a payout. Elites Funding reserves full and final discretion over payout approvals, amounts, timing, processing order, eligibility, and acceptance.

In the event of rule violations, suspicious activity, system abuse, identity inconsistency, account correlation, prohibited conduct, reputational abuse, payment-related irregularities, or any conduct deemed inconsistent with our rules, business model, or risk controls, all profits may be voided, all related accounts may be suspended or terminated, and no payout will be granted.

If an account is terminated while in profit, the user may request up to 50% of simulated profits only where such possibility is expressly allowed under the then-applicable rules. This is not guaranteed and remains subject entirely to company discretion, and such decisions shall be final and not subject to appeal.

All fees paid are for access to evaluation services and simulated environments. Fees are not deposits, investments, trading capital, custody assets, or client balances.

Once trading activity has begun, fees are non-refundable under any circumstances and may not be disputed, reversed, clawed back, or otherwise challenged through any payment provider except where expressly required by applicable law.

You agree to indemnify, defend, and hold harmless Elites Funding, its owners, directors, employees, agents, affiliates, service providers, contractors, successors, and assigns from and against any claims, damages, liabilities, losses, costs, chargebacks, penalties, expenses, and legal fees arising from your use of the Site, your breach of these Terms, your fraudulent or abusive conduct, your reputational attacks, or your violation of any law or rights of any third party.

All disputes shall be resolved exclusively through binding arbitration in Gibraltar. You may be represented by legal counsel or proceed without representation.

To initiate a claim, written notice must first be sent by certified mail to: MASTERLABS LIMITED, Suite 2, 260 Main Street, GX11 1AA, Gibraltar, with an electronic copy sent to [email protected].

All claims must be brought individually. You waive any right to participate in class actions, representative proceedings, collective actions, or coordinated claims against Elites Funding.

All services are provided "as is" and "as available" without warranty of any kind, express or implied. Elites Funding disclaims all warranties to the maximum extent permitted by law.

Elites Funding shall not be liable for any damages, including loss of profits, data, accounts, opportunities, commercial expectations, reputational harm, or indirect, incidental, punitive, consequential, or special damages arising from use of the Site or services.

Users accessing the Site from outside Gibraltar are responsible for compliance with local laws, sanctions regimes, and regulatory restrictions. We may restrict access, service availability, account eligibility, or payouts at our sole discretion based on jurisdictional, compliance, fraud, reputational, commercial, or operational considerations.

Elites Funding may suspend, terminate, restrict, freeze, or otherwise limit any account, service, program, or user relationship at any time without notice.

Upon termination, all rights to payouts, accounts, platform access, benefits, and services may be revoked immediately. Termination does not limit the Company’s right to retain records, deny future access, challenge payment disputes, or pursue legal or contractual remedies.

These Terms are governed by and construed in accordance with the laws of Gibraltar, without regard to conflict of law principles.

Elites Funding reserves the right to modify these Terms at any time. Continued use of the Site, accounts, programs, or services constitutes acceptance of the updated Terms.
